Escape Cottage, 20, Old Road. Llandudno. Ll30 2NB. Terms & Conditions of Letting.
These conditions carefully set out the basis of your agreement with ourselves. In making a booking, you warrant that you are above 18 years of age & that you have the authority to accept & do accept these terms & conditions on behalf of your party.
1. Duration & Times of Rental.
a. Rentals are for a maximum of four weeks & unless previously agreed by ourselves commence at 2pm on the first day of the rental & end at 10am on the day of departure. This letting does not confer upon you a shorthold tenancy.
b. The period booked will be stated on the confirmation e-mail. The period booked cannot be exceeded (this includes a late departure) unless guests have written approval from ourselves.
c. The guest will be liable for any cost, of whatever nature, incurred because of an unauthorised extension.
a. Upon booking a 25% non-refundable deposit is payable within 5 working days of your booking.
b. If a booking is made less than 6 weeks before the holiday is due to start, the full rent must be paid at the time of booking.
3. Final Payment.
a. The price for the holiday shall be the rent for the property as set out on the booking confirmation e-mail.
b. Subject to the Cancellation Provision in clause 5 below, as soon as the guests are in receipt of the Booking Confirmation, the guest is liable for payment of the balance of the rent.
c. Payment of the balance of the rent is payable to ourselves a minimum of 6 weeks before the start of the holiday.
d. If payment is not received by the due date, we will have to treat the non-payment as a cancellation of the holiday & the guest will lose their booking & the deposit paid.
4. Changing a Booking.
a. The dates of the holiday may be changed providing the property is available for the new dates & more than 42 days notice prior to the original holiday start date has been given.
a. Once a booking has been confirmed by ourselves, the booking can only be changed or cancelled with the written agreement of ourselves.
b. If you wish to cancel the booking the guest must notify ourselves in writing quoting “Cancellation Notice”.
c. A booking can only be cancelled prior to the start of letting. No refunds can be payable for curtailment of lettings.
d. In the event that a cancellation is made then a cancellation charge is payable depending on the number of days before the holiday start date that we have received the Cancellation Notice. The Cancellation Charge (as a percentage of the rental cost of the Holiday) is set out below:
0 to 13 days 100%
14 to 31 days 75%
32 to 41 days 60%
42 days or more = Deposit.
6. Method of Payment.
Payments may be made by cheque, credit/debit card or by bank transfer. Please make cheques payable to Vinit Malhotra. Credit/debit card payments can be made via Paypal using email address firstname.lastname@example.org. Post dated cheques are not acceptable. Any charges raised against Escape / ourselves by our bank for handling dishonoured cheques or any other payment will be passed on to the guest who is liable to reimburse.
7. The Holiday.
The guest has the right to occupy the property for a holiday only (within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988). The letting does not confer a short hold tenancy or give rise to a relationship of Landlord & Tenant.
8. Disabled, Infirm & Restricted Mobility Visitors.
Due to the age, location & character of the cottage, access to & the layout / features may be unsutable for visitors who are disable, infirm or who have restricted mobility.
9. The Guest’s Obligations.
The Guest agrees:
a. to pay for any losses or damages to the property & contents caused by the guest or a member of their party (reasonable wear & tear excluded).
b. to take good care of the property & leave it in a clean & tidy condition at the end of the holiday. A cleaning service is not provided during the holiday. Guests are asked not to:
– leave grill pan full of grease
– leave hob / oven / microwave splattered with baked on food.
– leave bins full of food / rubbish without a liner.
– flush non-biodegradable items down the toilet, causing blockages.
c. to permit ourselves reasonable access to the property
d. not to part with possession of the property, or share it, except with members of the party shown on the Booking Schedule
e. not to sell or transfer the booking to another party without our permission
f. not to exceed the total number of people stipulated in the property description
g. not to cause an annoyance or become a nuisance to occupants of adjoining premises
h. not to smoke in any part of the property
10. Non-availability of the Property.
If, for any reason beyond our control the property is not available on the date booked (owing, for example, to fire or flood damage or the property becomes unsuitable for holiday letting, all rent & charges paid in advance by the guest will be refunded.
a. All complaints must be notified to ourselves as soon as reasonably practicable, as we may be required to acrry out an on-the-spot investigation & if necessary, take remedial action. Guests have a legal obligation to mitigate their loss.
b, If we are denied the opportunity to investigate the complaint within a reasonable time or denied the opportunity to put matters right during the holiday, then the Guest will waive all rights.
Pets are only permitted with the prior written consent of ourselves & under the following conditions:
a. Only 1 adult (ie, over 1 year old) small dog is permitted. Sorry but no puppies allowed.
b. Pets must be fully housetrained.
c. They are to be kept under control & exercised off the premises.
d. Pets must not be allowed to foul in or around the garden.
e. Only those pets stated on the booking confirmation are allowed onto the premises.
f. Pets are not permitted upstairs or on the furniture under any circumstances.
g. Pets must not be left in the property unsupervised as this can result in considerable damage to the property & distress to the pet as they are in unfamiliar surroundings.
h. Your pet must not create a disturbance to neighbours.
i. You must clean & tidy up after your pet responsibly.
j. You must provide your own pet bedding & bowls & not use those provided by ourselves.
13. Your Belongings.
Your belongings, vehicles, their accessories & contents are left entirely at your risk. We do not accept any liability for loss of, or damage to, personal effects, baggage, vehicles or any other item belonging to the hirer or hirer’s party from any cause whatsoever.
14. Travel Insurance.
You are strongly recommended to take out personal travel insurance.
15. Breach of Contract.
a. In making a booking we will ask for personal information such as your name, postal address, e-mail address, telephone number & payment details. We may use the data to inform you about news & information we think may be of interest to you. We will not pass your information onto any third parties. By booking with us you are deemed to have consented to the use of personal information for these purposes.
b. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully, in accordance with the Data Protection Act 1998.
17. Validity Clause.
If any term or provision in these booking terms & conditions is found by any court, tribunal or administrative body or competent jurisdiction to be wholly or party illegal, invalid, void, voidable, unenforcable or unreasonable it shall to the extent of such illegality, invalidity, voidness or unreasobanleness be deemed to be sverable & the remaining provisions of the booking conditions & the remainder of such provision shall continue in full force & effect.
18. Governing Law & Jurisdiction.
The contract embodied in the booking is governed by British Law & subject to the exclusive jurisdiction of the British courts.
